Terms of Service

These Terms govern your access to and use of Learn Motion and explain the rights and responsibilities that apply to the Service.

1. Provider and scope

Learn Motion is operated by Wuhan Daoyin Technology Co., Ltd. (referred to as “we,” “us,” or “our”). These Terms apply to the Learn Motion mobile application, websites, and related learning services that link to these Terms. Our registered address is Building 8, SBI Entrepreneurship Street, Dongxin Road, East Lake High-tech Development Zone, Wuhan, Hubei Province, China.

2. Age and eligibility

You must be at least 13 years old to register for or use the Service. If the minimum age for consenting to a digital service is higher where you live, that higher age applies. If you have not reached the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms. Children under 13 may not register for or use the Service. If we learn that an account does not meet these requirements, we may stop providing the Service and delete the related personal information as described in the Privacy Policy.

3. The Service

Learn Motion provides AI-assisted learning services and related tools. The specific features, availability, and functionality may vary by device, platform, language, region, and service plan, and may change as the Service evolves. We may add, modify, suspend, or discontinue features in accordance with applicable law. Where required, we will provide notice of material changes affecting paid services or user rights.

4. Accounts and security

You may create and access an account through the sign-in methods supported by the Service. You must provide accurate information that you have the right to use, keep your account credentials and devices secure, and remain responsible for activity under your account. Contact us promptly if you discover unauthorized access or use. You may not transfer, rent, sell, or share an account to bypass eligibility, access, payment, usage, or security restrictions.

5. Automated features

The Service may use artificial intelligence and other automated technologies to process content and produce results. Automated outputs may be inaccurate, incomplete, biased, outdated, unsuitable, or inconsistent with your request. You are responsible for evaluating outputs before relying on or using them and must not treat them as the sole basis for professional advice or other high-impact decisions.

6. Your content and limited permission

You retain the rights you hold in content that you submit and represent that you have the rights required to submit and process it. To provide, maintain, and protect the Service, you grant us a limited, non-exclusive, worldwide, royalty-free permission to host, copy, transmit, transform, analyze, and display that content for the necessary period. This permission is limited to operating the Service, fulfilling your requests, providing support, maintaining security, and meeting legal obligations. Our handling of your content is further described in the Privacy Policy.

7. Use of generated content and public sharing

To the extent permitted by applicable law and third-party rights, you may use generated content for personal learning and other lawful purposes. Similar inputs may produce identical or similar outputs, so generated content is not guaranteed to be unique or free of third-party rights. Before publishing, distributing, teaching with, commercially using, or making important decisions based on an output, you must check its accuracy, suitability, attribution, copyright, trademark, privacy, and other compliance requirements.

If you choose to share content through or from the Service, you must have the right to share it. You grant us the limited permission needed to provide the sharing functionality, and we may restrict or remove content that is unlawful, infringing, harmful, or otherwise violates these Terms. Content shared through a third-party platform is also subject to that platform’s rules.

8. Acceptable use

You may not use the Service to break the law or infringe intellectual-property, privacy, personality, or other rights; upload personal information, confidential material, or malicious code that you have no right to process; create or distribute fraud, hate, harassment, child exploitation, explicit sexual content, dangerous instructions, or other unlawful or harmful material; bypass access controls, safety measures, subscriptions, quotas, or regional restrictions; or attack, disrupt, scrape, bulk-register, abnormally call, reverse engineer, or otherwise harm the Service or other users. To protect users, the platform, and third parties, we may review suspected violations and restrict, remove, suspend, or terminate access.

9. Intellectual property

Except for content submitted by users, the Service and its related technology, content, branding, and materials are owned by us or the relevant rights holders. These Terms grant only a limited, revocable, non-transferable right to use the Service in accordance with these Terms and do not transfer any intellectual-property rights. If you believe content in the Service infringes your rights, provide sufficient information for us to identify the content, verify your rights, and review the requested action.

10. Free and paid services

Some parts of the Service may be available without charge, while others may require payment or a subscription. Applicable prices, billing periods, included benefits, and any trial terms will be disclosed before purchase. Unless the purchase screen states otherwise, a subscription renews automatically for the selected billing period until it is cancelled. You may cancel through the purchase platform or customer portal that manages the subscription, and cancellation normally takes effect at the end of the current paid billing period. Refund eligibility is determined by the purchase platform’s rules and applicable law.

When Creem processes a purchase, Creem acts as the merchant of record and legal seller for that transaction. Creem handles payment collection, applicable indirect taxes, buyer invoices or receipts, refunds, and chargebacks under its buyer terms, while we provide and support the Learn Motion Service. Purchases made through Apple, Google, or another third-party platform are also governed by that platform’s billing terms and applicable law.

11. Third-party services

The Service may depend on or interoperate with products and services provided by third parties. Those products and services may be governed by separate terms and policies, and we are not responsible for matters outside our reasonable control. Our handling of personal information involving service providers is described in the Privacy Policy.

12. Changes, interruptions, and termination

We work to keep the Service available but do not guarantee that any feature will remain permanently available, uninterrupted, or error-free. Maintenance, upgrades, network failures, third-party services, device compatibility, force majeure, security risks, or legal requirements may cause delays or interruptions. We will provide reasonable advance notice when practicable for material feature or paid-plan changes. We may restrict, suspend, or terminate access if you violate these Terms, create a security risk, fail to pay applicable charges, or if the law requires us to act.

13. Account deletion and data deletion

You may request account deletion from the account settings in the App or through our Account & Data Deletion page. After you submit a request and complete any identity verification reasonably necessary to protect the account, we will delete your account and associated personal data, subject to limited retention required or permitted for legal, security, fraud-prevention, transaction, or dispute-resolution purposes. Copies in backups will be removed through the ordinary backup-rotation cycle. Deleting an account does not automatically cancel a paid service managed by an independent purchase platform; where applicable, you must also cancel it through that platform.

14. Disclaimers

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available.” We do not warrant that the Service or its outputs will be completely accurate, complete, current, fit for a particular purpose, uninterrupted, error-free, or non-infringing, or that use of the Service will produce any particular learning or other outcome. This section does not exclude warranties or consumer rights that cannot legally be excluded.

15. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential losses caused by reliance on generated content, user inputs, third-party services, devices, or networks. Liability that cannot legally be excluded will be determined under applicable law. Nothing in these Terms limits liability for intentional misconduct, gross negligence, personal injury, fraud, or any other matter that the law does not permit us to limit.

16. Governing law and disputes

These Terms are governed by the laws of the People’s Republic of China, without taking away mandatory consumer, privacy, or other protections that cannot be waived under the law where you live. The parties should first try to resolve a dispute through good-faith discussion. If no resolution is reached, either party may bring the dispute before a court with jurisdiction in Wuhan, China. If mandatory local law gives you a right to bring a claim before a local court or another authority, that right remains unaffected.

17. Changes and contact

We may update these Terms when the Service, business model, or legal requirements change. We will notify you of material changes through an in-app notice, page announcement, or another reasonable method and obtain renewed consent when required.
